Don't forget your start of tenancy necessities!


At the start of each new tenancy or tenancy renewal you must make sure you provide the tenants with a copy of the Gas Safety Certificate, Legionella Inspection Certificate, Energy Performance Certificate and a copy of the How to rent in England (in addition to complying with any licence requirements that the property might be subject to and following the deposit protection legislation).

Failure to do this may prevent you being able to use a Section 21 to end the tenancy.

Previously where landlord had not served the start of tenancy necessities at the start they would have been advised to do so as soon as they realised their mistake.  However a recent court case (Caridon Property Ltd v Monty Shooltz) a Judge refused to grant a possession order on Section 21 where a landlord has not served the tenant with the Gas Safety Certificate at the start of the tenancy but had served it before serving the notice.
